残疾人的权利在《残疾人权利公约》(CRPD) 和 1945 年印度尼西亚共和国宪法中得到法律保障。随着印度尼西亚通过《2011 年印度尼西亚共和国第 19 号关于批准《残疾人权利公约》的法律》批准了《残疾人权利公约》，所有与残疾人权利相关的法律产品，特别是本研究中的残疾人权利，都强调日惹市的教育部门必须以 1945 年印度尼西亚共和国宪法和《残疾人权利公约》的规定为基础。本研究的目的是根据 1945 年印度尼西亚共和国宪法和《残疾人权利公约》了解、理解、审查和分析日惹市教育部门加强残疾人权利的情况。本研究还旨在了解、理解、审查和分析日惹市在加强残疾人权利方面面临的司法限制。使用的研究类型是规范性司法研究，重点研究规则或规范在实在法中的应用。本研究采用的方法有法规法、分析法和案例法。作为批准《残疾人权利公约》和《1945 年印度尼西亚共和国宪法》授权的后续行动，特别是关于残疾人在教育领域的权利，有必要在日惹市地方一级实施一项实施条例，以执行《1945 年印度尼西亚共和国宪法》和《残疾人权利公约》的授权。在教育领域加强残疾人权利遇到了一些必须立即解决的司法限制。关键词：强化、残疾人权利、教育、1945 年印度尼西亚共和国宪法、CRPD
The rights of Persons with Disabilities obtain legal guarantees both in the Convention on the Rights of Persons with Disabilities (CRPD) and Constitution of the Republic of Indonesia 1945. With the ratification of CRPD by Indonesia through the Law of the Republic of Indonesia Number 19 Year 2011 on The Ratification of the Convention on the Rights of Persons with Disabilities, then all legal products relating to the rights of persons with disabilities, especially in this research, emphasize in the education sector in Yogyakarta city must be based on the provisions in the Constitution of the Republic of Indonesia 1945 and the CRPD. The purpose of this research is to know, understand, review and analyze the strengthening of the rights of people with disabilities in the education sector in Yogyakarta City based on the Constitution of the Republic of Indonesia 1945 and CRPD. This research also aims to know, understand , reviewing and analyzing the juridical constraints faced in the context of strengthening the rights of people with disabilities in the city of Yogyakarta. The type of research used is normative juridical research that is focused to study the application of rules or norms in positive law. The approach method used in this research is statute approach, Analytical Approach, and Case approach. As a follow-up to the ratification of CRPD and also the mandate of the Constitution of the Republic of Indonesia 1945 in particular with regard to the rights of persons with disabilities in the field of education, it is necessary to implement an implementing regulation at the local level of Yogyakarta City to carry out the mandate of the Constitution of the Republic of Indonesia 1945 and the CRPD. The strengthening of the rights of disability in the field of education is experiencing some juridical constraints that must be addressed immediately.
