The ICJ Advisory Opinion, delivered in July 2010, did little to change the situation regarding Kosovo, which it moved from one grey area to another. The long-running statehood and sovereignty problem needed the conceptual and political innovation necessary for a fresh framework. The creation of an EU'free territory'would provide that framework. Other options put forward for resolving the Kosovo conundrum, as well as international engagement and peacebuilding, have been inadequate. The adoption of the EU Kosovo'free territory'concept would benefit all concerned-in Kosovo, Serbia, the EU, and beyond, including the US, and would be endorsed by the UN Security Council. The voluntary nature of a'free association'agreement would remove any grounds for objection. The EU would be able to maintain unity and consensus, and be in a position to take important decisions regarding the future development of Kosovo.
