It has long been recognised that there are significant variations in the use of bail in magistrates’ courts. A recent study carried out in South Wales suggests that these variations cannot be fully accounted for by differences in the cases heard. The findings suggest that the explanation lies in the culture of the courts and the effect that this has on the working practices of participants, principally the Crown Prosecution Service (CPS) and defence solicitors which in turn reinforces and perpetuates the ‘court culture’.
