With most of the world's drug development companies gearing up for genomics-based drug discovery, it is important to step back and gauge the type of intellectual property (IP) protection that will be available for these pioneering discoveries. At present, the legal system is moving in a direction that will make it easier than ever to acquire DNA patents, but virtually impossible to prevent infringement. This" onehand-giveth, the-other-taketh-away" dilemma is the result of seemingly contradictory agendas between the US Patent and Trademark Office (PTO; Washington, DC)-the giver and the court system-the taker. If you are contemplating product development based on genomicsbased IP, it is important that you understand how these trends affect the IP underpinnings of your potential product.
