Com a impossibilidade de o direito interno dos Estados responder de forma unissona e eficaz contra a problematica da corrupcao, a sociedade internacional se reune a fim de criar regras harmonicas para o combate a todas estas formas de suborno, quando uma pluralidade de ordenamentos juridicos se interessa a conduta criminosa. Com a globalizacao, intensificou-se a rede de trocas comerciais, investimentos e servicos que cruzam fronteiras, logo, a criminalidade corrompedora tambem se globalizou, e os casos de corrupcao de funcionarios publicos que um determinado Estado praticados – ou requeridos – a funcionarios de empresas de outros Estados nao podem ser negligenciados. Exatamente nesta perspectiva exsurge a contribuicao do direito internacional, seja ele convencional (como as Convencoes da OCDE, ONU e OEA sobre o tema), ou pertencente ao chamado direito derivado (oriundo de decisoes e declaracoes proprias da atividade de uma organizacao internacional). Tal auxilio do ordenamento juridico internacional e objeto deste trabalho, alem de apresentar os conceitos modernos de corrupcao, fato economico de grande interesse juridico. ABSTRACT In spite of the impossibility of the municipal law to fight similarly and efficiently against corruption, the international society tries to establish harmonic rules for the combat to these forms of bribery, when a plurality of legal systems is interested to pursuit the criminal conduct. With the globalization, the net of commercial exchanges intensified, investments and services that cross frontiers, soon, the criminality is also internationalized, and the cases of public officials corruption to officials of enterprises of other nationality cannot be neglected. Exactly in this perspective international law contributes, both by conventional arrangements (such as the OECD, UN and OAS Conventions on the subject), or pertaining to the called secondary legislation (originating from decisions and declarations own to the activity of an international organization). The development of international legal order and the modern concepts of corruption, an economical fact of great legal interest are the center of this paper. KEYWORDS: Fight against corruption.
