When Juries Come to Russian District Courts: Lay Participation Expansion and Court System Non-Compliance

Abstract:Drawing on original interview data collected in 13 regions of Russia in 2018-2021, as well as official court statistics, the article explores the latest reform of jury trial, which extended it to district courts. Promoted as a democratic tool, the reform was meant to increase levels of lay participation and to address the issue of accusatorial bias in the Russian judiciary. The paper demonstrates that while these goals have partially been achieved, the reform is bordering on failure due to implementation issues stemming from deep-rooted resistance within the judiciary itself. With the help of interview data and official court statistics, the article identifies the main reasons for this resistance and provides evidence that judges use two main strategies to sabotage the reform: overturning acquittals granted by juries and jury trial penalty.
