ZusammenfassungDie politikwissenschaftliche Transformationsforschung der letzten beiden Jahrzehnte hat erheblich zum Verständnis der Ursachen, Verlaufsformen und Ergebnisse von Prozessen der Demokratisierung und demokratischen Konsolidierung politischer Systeme beigetragen. Gleichwohl hat sie es bislang weder verstanden, die Struktur und Funktionselemente einer Vielzahl von jungen Demokratien der dritten Welle begrifflich zu fassen, die in der Grauzone von konsolidierter, liberal-rechtsstaatlicher Demokratie und offener Autokratie siedeln, noch bietet sie ein typologisches Konzept, dass es erlaubt diese neuen Regime systematisch von rechtsstaatlichen Demokratien zu scheiden. Ausgehend vom Grundtyp der liberalen Demokratie bildet die defekte Demokratie einen Subtyp demokratischer Regime, der seinerseits wieder in drei Typen differenziert werden kann: die exklusive Demokratie, die Enklavendemokratie sowie die illiberale Demokratie. Letztere löst den komplementären Zusammenhang von privater und öffentlicher Autonomie, Rechtsstaat, Gewaltenkontrolle und Demokratie einseitig auf. Die Beschädigung rechtsstaatlicher Prinzipien, die partielle Ausschaltung der Gewaltenhemmung und die eingeschränkte Wirksamkeit bürgerlicher Freiheits- und Schutzrechte sind die definierenden Merkmale illiberaler Demokratie und zentrale Bestandteile ihrer Funktionslogik. Das Entstehen illiberaler Demokratien kann partiell mit der Verdrängung formaler Institutionen des Rechts- und Verfassungsstaates durch informale Regeln und Institutionen erklärt werden. Die Informalisierung politischer Verfahren und Entscheidungsregeln ist wiederum vor allem das Resultat von drei sich wechseleitig beeinflussenden Faktorenbündeln: (1) einem vor-demokratischen Erbe des Informalen, (2) einer aus der autoritären Phase übernommenen ökonomischen und politischen Problemakkumulation post-autoritärer Systeme sowie (3) dem Zusammenwirken von Faktorenkonstellationen auf der Ebene der formalen Verfassungsinstitutionen, des sozio-politischen Vermittlungssystems sowie auf der Ebene der politischen und sozialen Kultur der Demokratie. Diese Faktoren verdichten sich zu einem „illiberalen Code”, der die politische Entwicklungsdynamik solcher Demokratien maßgeblich prägt.AbstractThe last quarter of the 20th century saw the worldwide advance of democracy. However, almost three decades after the beginning of the third wave of democratization, the empirical evidence increasingly suggests that this wave could become less a triumph of political liberalism and much more a success story for a “defective” form of democracy. The mainstream of theoretical and empirical ‘consolidology’ speaks of democracies and autocracies. This crude dichotomy does not allow for more differentiated judgments and conceptualizations of the structural and functional elements of this regime-type that has developed in the grey area between consolidated, liberal democracy and open autocracy. Thus far, a theoretical concept enabling the new regime-type to be systematically differentiated from democracies based on the rule of law, the reasons for its emergence to be clearly set out, and the specific dynamics of its development to be explained, has thus far been lacking. To overcome this shortcomings this article presents a multidimensional concept of democracy that allows, to distinguish between liberal democracies based on the rule of law and defective, or illiberal, democracies. From developing a three-dimensional typology for classifying three subtypes of defective democracies (exclusive democracy, tutelary democracy, illiberal democracy), the paper is focused on the illiberal democracy, more specifically on the questions what are the defining characteristics of illiberal democracies, and what are the reasons for their emergence. We will examine the specific interdependence of formal institutions and informal institutional arrangements, which we consider to be one of the central features of illiberal democracies and, finally, we will outline possible scenarios for the future development of illiberal democracies.
