Caps on noneconomic damages have been the darling of tort reformers at both the federal and state levels during the latest medical malpractice crisis, just as in previous crises. The question of whether limitations on damages are permitted under state constitutions has played importantly in tort reform debates in a number of states. In this article, we review case law addressing this issue and comment on the prospects for caps legislation going forward.
