EnglishThe author examines from a Latin American perspective, the debates of the sixteenth century on the “rights of the people” that examine the essential issue about who counts as “human”, issue no yet unraveled by the Latin Americans and the whole world. It deals with a question that has worried many feminists within the region, regarding their fight for extending human rights to women, beginning by the notion of the “right to be entitled to rights”. The hierarchical logic imposed in 1492 on the relationships between settlers and natives, persists nowadays and is reflected in the facts that are often accounted by the first pages of local newspapers in Mexico and Central America: violations, mutilations and the murders of women whose lives seem to be less valuable than others. The genocidal justification of the conversion has been metamorphosed, but remains present. In Latin America today, the discourses of modernization, capitalism, and democracy resemble the discourses of the sixteen century on “the rights of the people”. Both types of discourse hide the face of human suffering
