: The aim of this study is to demonstrate that the patient's self-determination in health matters constitutes the central core of informed consent. Using the method of documentary research, of a qualitative nature, it starts from three basic premises: (i) the genus-species relationship, placing informed consent as a species of the genus medical act; (ii) the distinction between clinical in-formation and therapeutic information favors the understanding that the medical act can be bro-ken down into two parts, informed consent and the provision of health care; and (iii) informed consent is found in the medical act, regardless of the contractual or non-con-tractual nature of the doctor-patient relationship. Next, the complex obligatory program of informed consent is ana-lyzed, highlighting the positive provision of information and the negative provision of refraining from carrying out the provision of health care without or against the patient's manifestation of will. Finally, the nature of the patient's consent is discussed, in order to fit it into the figure of acceptance in the formation of contracts, applying the respective legal regime, with the exceptions of free revocability and without compensation.
