项目摘要

2022年度では、大日本帝国憲法（明治憲法）の制定前後において、皇室と政治の関係を規定するものとしての立憲君主制が形成される過程を分析した。具体的には以下の2点から研究を進展させた。第一に、近代日本の立憲君主制を制度上確定させた明治憲法の制定に際し、イギリス立憲君主制の諸相がイギリス人法律顧問ピゴットの答議等をもとに検討された過程を考察した。結果、憲法制定を主導した伊藤博文にはイギリス憲法の導入可能性を精査する意図が存在し、かかる目的のためピゴットが招聘され、その答議が憲法起草の最終局面で参照されたが、大臣輔弼の原則についてはイギリスの学説が相当に摂取されたものの、大臣の対議会責任、議院内閣制・連帯責任制、緊急勅令の免責法による承諾といったイギリス立憲君主制の議会主義的側面や「君臨すれども統治せず」の理念は概して否定されることとなったことが明らかとなった。以上の考察に際しては、「伊東巳代治関係文書」（国立国会図書館憲政資料室所蔵）や井上毅の旧蔵文書を収める「梧陰文庫」（國學院大學図書館所蔵）のほか、ピゴット招聘に係る外交公電（外務省外交史料館所蔵）やイギリス外務省文書（横浜開港資料館所蔵）、憲法起草者が参照したイギリス憲法に関する文献の手拓本（国立公文書館所蔵）等を調査した。第二に、近代日本の立憲君主制が明治憲法施行後にいかなる態様を示したのかを、初期の緊急勅令の運用過程への着目を通じて考察した。この研究は未だ途上にあるが、これまでに緊急勅令案に関する閣議書の原議や枢密院会議での審議、発出された勅令の諾否をめぐる帝国議会での審議、発出に関与した政府関係者（白根専一内務次官等）の私文書を調査した。今後は、各政党の機関誌（紙）や党員の私文書を網羅的に調査することで、緊急勅令の発出によって惹起された立憲君主制構想の多元化や政府－政党間対立の一端をも解明することを目標とする。

This paper analyzes the process of forming the constitutional monarchy before and after the formulation of the Constitution of the Great Japanese Empire (Meiji Constitution) in 2022 and the regulation of the political relations between the imperial family and the imperial family. The specific research progress is as follows: First, the constitutional monarchy of modern Japan was established during the formulation of the Meiji Constitution. The result is that the constitution is being drafted in a leading way, and the possibility of introducing the constitution is being examined carefully. The intention is to exist, the purpose is to recruit, and the answer is to make reference to the final situation of the constitution drafting. The principle of the minister's assistance is to make the theory of the constitution equivalent. The parliamentary responsibility of the minister is to make the parliamentary cabinet system responsible. The principle of "sovereignty" and the principle of "sovereignty" are the basic principles of constitutional monarchy. The above investigation was carried out in the context of the "Ito Miyoji Relations Document"(Collected by the Constitutional Data Center of the National Diet Library), the "Wu Seal Cutting Library"(Collected by the National Academy University Library), the "Foreign Affairs Office"(Collected by the Ministry of Foreign Affairs Foreign Affairs Historical Materials Center), the "Ministry of Foreign Affairs Documents"(Collected by the Yokohama Port Data Center), and the "Handwritten Copies" of Documents Related to the Constitution (Collected by the National Public Library), etc. Second, the constitutional monarchy of modern Japan after the implementation of the Meiji Constitution from the beginning of the state, the initial emergency order of the application process, and through the investigation This study was carried out by examining the original proposals of the Cabinet and the Privy Council meetings, considering and issuing the orders, and investigating the private documents of the Imperial Parliament, which issued the relevant government relations (such as the Secretary of State for Internal Affairs). In the future, the organs of political parties (paper) and the private documents of party members will be investigated, emergency orders will be issued, and the idea of constitutional monarchy will be diversified. The end of the government-party confrontation will be clarified.
