本研究の目的は、近年活動が活発化する超企業的な労働組合である合同労組に着目し、合同労組の視点から労働組合法上の「使用者」概念を明らかにすることである。本年度は地方の中小企業の経営状況・労働環境を明らかにしつつ、上部団体を持たない合同労組の実態を踏まえ、人材・資金の確保という観点から労働組合法に相当する台湾工會法の財源規定及び集団的労使関係法上の雇主概念の研究を行った。労働法学では、理論面からのアプローチや判例研究が一般的であるが、本研究では地方の労働環境の実態に着目して調査を行った。岐阜県の東白川村・白川町にてインタビュー調査を実施したところ、人間関係を重視するあまり紛争を回避する傾向が強いこと等から労働者が使用者に交渉を求めにくいこと等が明らかとなった。昨今では、上部団体を持たない合同労組も見受けられるため、上部団体を持たない合同労組の実態調査を実施したところ、組合運営について人材・資金の面から課題を抱えていることが明らかとなった。中小企業の労働環境、合同労組の状況についての法的アプローチを模索すべく、工會法研究を行った。台湾は中小企業の割合が高い。台湾の労働組合である工會の組織率は低く、台湾の中小企業工會の財政状況は非常に悪い。工會法では一定の要件のもとに雇主に代わって管理権を行使する管理者を加入させることで人材を確保することができる。また、チェック・オフや政府補助金等を法定することで工會の資金を確保することができる。労働組合法上の「使用者」概念に相当する工會法上の雇主概念は、日本の学説の影響を強く受けている。不当労働行為制度の目的に鑑み、工會法35条の雇主概念は労働契約上の雇主に限定することなく、また会社法の規定に関わらず、実質的管理権または実質的な実施者に鑑みて支配従属関係を判断する等、雇主概念を拡大する方向での議論が一般的であることが明らかとなった。
