项目摘要

本年度は、昨（2021）年度に引き続き、国内およびグローバルな法の支配の理論や思想、歴史に関する日本・海外の先行業績の資料収集を行うとともに、法の支配の理念に関する一般法理論的な検討を進め、研究の一部の公表を行った。単著『国際法哲学の復権』においては、法の支配こそが法を法たらしめる理念であること、そこには国際法を通じた国内法体系間の相互尊重が含まれることを示した。この知見がもたらすののは、日本法における法の支配は、その内部で自己完結するものではなく、国際法への向き合いかたという側面を必然的にもつことへの理解である。このことは、グローバル化の中で立憲主義的人権保障が国際化する傾向にあるというにとどまらず、そもそも歴史的に見て国内における法の支配の確立が、グローバルな主権国家体制の成立・普遍化によって要請されてきたという歴史的文脈に照らして理解されねばならない。法治国家や法律の留保などの原理・理念は、国内における貫徹という観点からのみ論じられがちだが、そこで言及される法が法の名に値するためには、他の法体系によって正当に法と見なされるための根拠（つまり法の支配）を備えていなければならないとすれば、公法学をはじめとする実定法諸学における法理解や法解釈態度にも再考が促されることになる。また、法の支配が国際法への対しかたにも関わるのだとすれば、国際法上の義務の形式的な遵守だけでなく、その形成・発展について積極的に関与することが、日本の外交政策にとって重要な意味をもつはずである。
