项目摘要

スラップ対策に関する動向は流動的である。アメリカ合衆国では、2022年現在、32の州及び１つの地域でスラップ被害防止法が制定されている。また、統一州法に関する全国委員会が、2020年7月にモデル「統一公的表現保護法（Uniform Public Expression Protection Act (UPEPA)）」を提示した。他方、2015年にワシントン州、2016年にミネソタ州の最高裁判所が、それぞれのスラップ被害防止法を違憲と判断している（なお、ワシントン州は、2021年5月にUPEPAバージョンを新たに制定している）。そして、約20の州は、スラップ被害防止法の制定に消極的である。注目すべきは、2022年2月、「国連ビジネスと人権ワーキンググループ」は、声を上げる人権擁護者を脅迫し黙らせることを目的としたスラップ訴訟に対して警鐘を鳴らしている。国に対しては、スラップ被害防止を制定するべきであるという提言がなされ、また、企業に対しては、名誉毀損による損害に対して巨額の賠償を要求すべきではなく、人権擁護者への攻撃・報復を防ぐために人権デュー・ディリジェンスを実行すべきであると指摘している。本研究の2022年度の目標は、前年度に引き続き、「学説を網羅的に調査・検討」することを主眼とし、「法分野別に紛争を類型化して分析を行う」ことを目標としている。この計画に従い、前者に関しては、これまでの研究の集大成として、アメリカ合衆国の概要を含め、名誉毀損法の憲法化及びスラップ対策に関して、『名誉毀損訴訟と表現の自由』（成文堂、2023年9月刊行予定）を出版予定である。また、後者に関しては、『「スラップ訴訟」の意義と実務対応（仮）』（日本法令出版、2023年10月刊行予定）において、日本におけるスラップ訴訟の現状及び有効なスラップ対策を分析している
