项目摘要

令和4年度においては、英国ロンドン大学ロイヤルホロウェイカレッジのEugenio Vaccari講師、英国エセックス大学Marique Yseult教授、米国アリゾナ州立大学のLaura Coordes教授によるプロジェクトである「When Liquidation is NOT an Option: A Global Study on the Treatment of Local Public Entities in Distress」に引き続き参加し、自治体破綻法制の比較研究の一環として、わが国の制度について英文により紹介、分析を行うことが中心となった。本分析においては、わが国の破産法制の特徴について、アメリカにおける第7章の手続と第11章の手続の両方の手続を持っているが、地方公共団体については破産能力がないとされていること、例外的に地方公共団体の財政の健全化に関する法律（地方公共団体財政健全化法）が制定されていること、旧地方財政再建促進特別措置法（旧法）では、早期健全化の枠組みや地方公営企業や第3セクターを含めた財政再建の枠組みが欠如していたが、地方公共団体財政健全化法では、早期健全化の枠組みが作られ、地方公共団体が公表した健全化判断比率が早期健全化基準や再生判断基準により地方公共団体の財政状況が判断されるようになったことを示した上で、わが国の自治体破綻法制は現状ではうまく機能しているもののの、夕張市においては負担増により人口減少や少子高齢化の問題が顕著に表れていること、将来的には債務調整も必要になりうることを指摘した。
