项目摘要

今年度は、岡松は、引き続き、原子力の平和利用から生じる諸問題について、海洋汚染問題に焦点を当てて研究を行った。特に、ロンドン海洋投棄条約および議定書の締約国会議で議論された福島原発からのALPS処理水についての法的論点を明確にし、国連海洋法条約による海洋環境保護の問題と合わせて検討を行った。森田は、立法管轄権のいわゆる「域外適用」問題につき、従来、大きな混乱と対立が存在しており、引き続き、分析を進めた。これに関して、「ある法(lex lata)」と「あるべき法(lex ferenda)」の区別が依然として重要であることの他に、国際法が、立法管轄権のいわゆる「域外適用」の「紛争」要因にどのように対応することで、防止し、解決することができるか、期待される国際法の機能に着目して、検討を進めた。青木は、月や火星をはじめとする有人・無人の惑星探査に向けて米国は、2020年には、「原子力電源・推進力利用」を強化するための国家宇宙政策指令（SPD-6）を策定した。日本は現在、宇宙での原子力電源利用計画をもたないが、将来の利用のための準備として、国家管轄権の行使が不可能な天体における恒常的活動のための安全区域設定の要件を考察した。また、ウクライナ戦争終結後を睨み、核軍備管理・核不拡散の動向調査を行った。国際私法の観点から、道垣内は、英国の原子力発電事業の推移を踏まえ、原子力発電の将来を支える原子力損害賠償法制を概観するとともに、現実に生じた小規模な原子力事故の処理に関する論文の執筆活動を行った。この論文は2023年度以降に公表の予定である。

After the end of the war, nuclear arms management and nuclear non-proliferation trend investigation are carried out. International private law issues, the development of nuclear power generation in the United Kingdom, the future support of nuclear power generation, the legal system for nuclear damage compensation, and the current development of small nuclear power accidents related to the writing of papers. This paper is scheduled for 2023.
