令和4（2022）年度も前年度に引き続き、旅行サービスの提供に関する契約において、契約締結から実施されるまでの間に、その実施・継続を妨げうるリスクまたは旅行者に損害を及ぼし得るリスクがどのように存在するかについて、紛争実態(裁判例および日本旅行業協会(JATA)や業界誌において紹介されている苦情例)およびその解決の在り方を把握した上で、契約当事者である旅行業者、旅行者のいずれがかかるリスクやそこから生じた損害をどのように負担すべきかについて、検討を進めた。わが国では旅行業者との間で締結される旅行契約において、いわゆる標準旅行業約款がその取引上の規律として重要な役割を担っている。それによれば、旅行者に対して旅行開始前および旅行開始後の解除権が与えられ、特別補償制度による補償金・旅程保証制度に基づく変更保証金の支払いにより旅行者に対する事前・事後の救済がある程度図られており、判例および苦情の解決においても同約款に基づく規律が基礎とされている。しかし、同約款のもとでも、旅行業者に付与されている解除権の適切な行使がなされなかったために旅行が中断し、あるいは旅行の中断の必要性が客観的に乏しいにもかかわらず旅行業者によって旅行が実施・継続されてしまった場合等、解除権の不適切な行使または不行使の可能性があることが明らかになった。また、旅行者に損害が生じた場合、あるいは期待した旅行の実施がなされなかった場合に同約款に基づき支払われる補償金・変更保証金の支払いも、旅行者に生じた損害の完全な填補がなされるものではなく、加えて旅行上生じうるあらゆるトラブルに対応するものではない。さらに、旅行契約に関する紛争は、旅行業者以外の者との間で旅行契約が締結されたケースにおいてもみられ、そうした紛争においては標準旅行業約款が規律としての意味をもたず、旅行契約自体を対象とした規律の必要性が明らかとなった。
