项目摘要

令和４年度は、ドイツのマックス・プランク外国私法・国際私法研究所を拠点として、デジタルプラットフォームをめぐる問題について、特にＥＵ法とドイツ法に関する資料の収集と分析を行った。具体的には、①前年度に引き続き、EUのデジタルサービス法（DSA）規則（提案）COM(2020) 825 finalの分析を継続した。その成果として、拙稿「デジタルサービス法規則提案にみるデジタルプラットフォーム規制」を令和４年度中に公表する予定であったが、出版が遅れたため、次年度の公表となる。また、令和4年10月にDSA規則提案が正式に採択されたため、DSA規則(EU) 2022/2065の翻訳作業にも取り掛かった（公表は次年度の予定）。この他、成果の一部として、京都弁護士会でEUの法状況について報告をし、意見交換を行った。②オンラインマーケットプレイスの私法上の責任に関しては、特に、ヨーロッパ法研究所（ELI）が公表した「EU製造物責任指令改正提案」と、EUの欠陥製造物の責任に関する欧州委員会及び理事会指令のための提案COM/2022/495 finalの翻訳と分析作業を進めた。翻訳については、次年度に公表予定である。③オンライン広告をめぐる問題（特に、ドイツにおけるインフルエンサーによるマーケティングに関する裁判例や行動ターゲティング広告）に関する資料の収集・整理・分析を行った。この他、マックス・プランク外国私法・国際私法研究所を通じて人的ネットワークを広げたほか、ヨーロッパ法協会（ELI）の学会、オスナブリュック大学のブッシュ教授との共同研究会および国内の（オンライン）研究会に参加することで、知見を深めることができた。
