本研究は、医療観察法鑑定入院対象者に対する付添人弁護士が医療連携活動において果たすべき役割を明らかにすることを目的に行われた。2021年度の予備的検討に続き、2022年度においては、付添人業務の経験がある弁護士を複数名選出し、研究遂行にかかるエキスパートパネルを結成することを目的とした。「弁護士情報提供サービスひまわりサーチ」において取扱業務として「心神喪失者等付添」を登録している全国の弁護士を対象とした。ただし東京都は出身都道府県を登録してある者のみに限定した。選定基準に合致する研究対象者数1116人の全例を対象とした。紙媒体の調査票を全国の弁護士事務所に郵送し、返送を求めた。調査項目は、付添人経験の有無及び頻度、付添人活動において気づいたこと等である。本研究は臨床研究法その他の関連法規の規制の範囲には含まれないが、人を対象とする医学系研究に関する倫理指針に則ってこれを行うものとする。本研究は当学の倫理審査委員会の承認を得たうえで実施された。結果として143通の有効回答を得た。回答者半数弱が付添人業務の経験を有していた。経験回数の平均は3.2回であった。経験者の過半数が関係各所との連携に困難を感じた経験を有していた。その中でも対象者及びその家族との関係構築に困難を感じた回答者が多かった。4分の1の回答者が鑑定入院医療機関での医療ないし処遇に疑問を持った経験を有していた。疑問の内容としては、医療内容が適切でない、対象者が不満を持っている、必要な医療提供がなされていない、入院環境に問題がある、との回答が比較的多かった。医療ないし処遇の改善のため鑑定入院医療機関と連携したことのある回答者は4分の1に留まった。2023年度はこれらの結果を踏まえてエキスパートパネルを結成し、付添人が鑑定入院医療機関との連携において果たすべき役割についてのコンセンサスを見出すことを目標とする。
