CrocqとGijsbersの議論の応接を再構成し、フランス法における担保と所有をめぐる議論の総体を捉えることを本年度の課題としていたが、部分的に達成するにとどまっている。公表に漕ぎ着けた部分との関係で言えば、フランス民法典が規定する譲渡担保に即して、その法的構成を規定する具体的考慮を明らかにしたが、本来は、この担保制度を超えて、より一般的に所有権担保の議論を分析するはずであった。その意味で不十分な成果になってしまっている。しかし、所有権担保の法的構成を構想するにあたり様々な考慮がありうる中で、担保権者が所有権を有することが設定者の責任財産（正確には資産patrimoine）に与えるインパクトをどのように捉えるかがその法的構成を規定する重要な考慮になっている。そして、伝統的な物的担保をモデルとしたり、設定者保護を強調する思考は、相対的に劣後する。こうした認識を得られたことが重要な収穫である。この認識自体いまだ仮説の域を出ない一応の理解であるように思われるが、より精緻なものにしながら、同時にその検証を行うことが直近の課題である。以上の認識を前提としながら、日本法の検討にも取り掛かり、特に、譲渡担保の実行と、倒産法上の譲渡担保の処遇について、分析を進めた。いずれも、近時の議論によれば、譲渡担保の法的構成論との関連性が相対的に弱い領域であるとされているが、フランス法の検討から得られた示唆を踏まえて、これらの問題を規律する考慮を洗い出し、また後者の問題に関連して最新の倒産法学の議論の摂取を積極的に行なった。
