项目摘要

本研究は、情報の保存方法の多様化によって生じる法的問題に対処するための理論構築によってサイバー犯罪やインターネット上での人権侵害防止のための制度提案を目標とする。本研究においては、情報通信技術・暗号理論などを踏まえた法理論構築を目指すものであり、2022年度は、2020年度・2021年度情報通信技術、暗号理論、法学理領域について文献調査を継続して行った。まず情報通信技術・暗号理論領域の研究については、ブロックチェーンやクラウドコンピューティングの実施状況、運用例についての調査を行った。次に法学領域については、近時の法実務の状況を調査するとともに、情報法および刑法領域における国内外の文献調査を行った。とりわけ個人情報保護法制及びAIによる違法情報生成をめぐる法的問題についての調査を中心に行った。なお外国文献についての調査としては、米国・カナダ・ドイツを中心に調査を行った。文献の調査はオンライン文献や資料の購入のほか、国立国会図書館関西館において本研究にかかる資料につき、非公表学位論文および撤回された学位論文を含め調査を行った。2022年度は研究のとりまとめを行うことを予定しており、前記のとおり2021年度までの調査を継続するとともに、研究のとりまとめを行い、研究成果の公表のための情報整理を行った。本研究の調査の内、研究の一部として行った違法情報生成に関し、日本カナダ学会第47回年次研究大会において「カナダにおけるディープフェイク対策の現状と課題」として研究発表を行った。
