项目摘要

本研究では応急手当等を自らの判断で行った一般市民が損害を受けた場合、①健康被害等に対する補償（応急手当等を実施した際に、傷病者の血液等が身体に付着し、血液感染が心配で医療機関を受診した．など）、②法的責任を問われた場合の補償に分類して、その補償の存在等を明らかにすることを目的としている。一般市民が応急手当を行ったために、自らが損害を受けてしまった場合の補償に関して、「交通事故現場における市民による応急手当促進方策委員会報告書」では①健康被害等に対する補償（応急手当を行った者に対して）について、「その補償対策を講じておくことが、応急手当の普及推進を図るためにも不可欠である。」としているが、警職協力者災害給付法において、明らかな因果関係が立証されない限り、血液感染などの損害を補償されない可能性が高い。また、②法的責任を問われた場合の補償について、応急手当が実施されるほとんどの場合は緊急事務管理（民法第698条）が適応されると結論付けている。「民事上免責される範囲が広く、応急手当を受けた傷病者が万一、重篤化したとしても法的責任はまずないと考えられる。」とある。[確実にないとは言い切っていない．また、依頼によって応急手当等を行った場合（救急隊員による依頼や口頭指導による）には緊急事務管理は成立しない．]裁判所の裁判例情報によると、緊急事務管理の判例は４例存在する。４例中3例は緊急事務管理の成立を認めていない（1例は結審していない）。裁判は緊急事務管理を積極的には認めない傾向がうかがわれる。これらのことから、未知である消防機関等の補償制度を調査、分析することは意義があることと考える。2020年度は常備消防本部（726消防本部）への現状把握型アンケート調査を実施予定であったが、コロナ禍を鑑み、新潟県内19消防本部に限定して調査を進め、その損害補償について検証した。
