本研究では，加盟国の選好に注目した従来の制度設計過程分析に対し，制度運用の結果が再び制度設計へと影響を及ぼすフィードバックに注目した分析を行うことを目的としている．このフィードバックの経路として欧州司法裁判所の判例を取り上げ，判例が制度改定へと及ぼした影響の実証的分析を遂行している．今年度はこれまでの資料調査を踏まえ，本研究の成果となる研究報告をグローバル・ガバナンス学会第15回研究大会（於 名古屋）で，「ECJ判例の及ぼす欧州統合過程への作用」と題して行った．この報告では，Kalanke事件に端を発したポジティブ・アクションを巡るEU指令決定過程およびEU基本条約改定交渉の分析を行い，ECJが条約改定交渉に及ぼした影響を明らかにしている．また，他の研究者との共同研究にもこの報告における研究成果を活用した．国際関係論における制度作用への注目を代表するリベラル制度論を，その提唱者であるR. O. KeohaneのAfter Hegemonyに基づいて考察し，EUにおける3つの事例と照合し，その理論的整合性の検討をこの共同研究では行った．その成果は所属先の神戸大学国際文化学研究推進インスティテュートが発行する『年報Promis』で，「EUにおける制度作用の考察：After Hegemonyからの理論的示唆を基にして」として公表済みである．研究成果は少しずつ形になっており，これを論文として完成することが残された課題である．

This study focuses on the analysis of the institutional design process of the participating countries, the results of institutional application, the impact of institutional design, and the analysis of institutional design. The case law of the European Court of Justice was adopted, and the analysis of the case law, the system reform and the effect of the case law on the evidence was carried out. This year's research report on the results of this research was presented at the 15th Research Conference of the European Union Society (Nagoya), entitled "ECJ Case Law and the Role of European Integration Process." This report is based on the analysis of the EU Directive decision process and the EU Basic Treaty Amendment Agreement, and the implications of the ECJ Treaty Amendment Agreement. The results of joint research by other researchers were reported and utilized. International relations theory, institutional role, attention, representative, institutional theory, proponent, R. O. Keohane's After Hegemony foundation is investigated, EU's case study is combined, and theoretical integration is discussed. The results of the study were published in the "Annual Report Promis" of the International Cultural Research Promotion Department of the University of Kobe,"An Investigation of the Role of EU Institutions: After Hegemony, the Basis of Theoretical Demonstration". The research results are endless, and this paper will complete this difficult topic.
