本研究は、海上保安業務の実態の応じた海上規制法制の見直し(とくに各海域における新たな課題への対処)を目的としており、研究の前提として現体制の実態調査のために現場視察が不可欠であるところ、2021年度は、コロナ禍の影響のため、予定していた視察等の実施は次年度以降に見送らざるを得なかった。他方、オンラインを利用した研究会を実施し、下記のとおり、(1) 漁船八重丸衝突事件無罪判決について、(2)国際海上警察法の生成と展開という2つのテーマについて分担研究者からそれぞれ報告を受けた上で、全体討論を行った。(1)は、福岡高宮崎支判令和4年1月27日の業務上過失傷害、業務上過失往来危険被告事件に関する無罪判決についての検討を行うものであった。同判決が原審である鹿児島地判令和2年3月18日の有罪判決を破棄して無罪判決を出したため、判決文を検討しながら、漁船同士の衝突事故に係る過失認定、灯火表示義務と過失判断の関係、信頼の原則、直近過失の捉え方等の論点について議論した。(2)は、2020年11月時点の中国海警法における武器使用許可の発表をきっかけに、海上執行法上の武力行使ルールを国際法の観点から検討しようとするものである。海洋法条約以前の諸外国の関連判例が照会された上で、現海洋法条約の関連規定および公海漁業実施協定、SUA 条約2005議定書の武力行使ルール、海洋法条約発効後の司法判断をふまえて、外国船による違法操業時、立入検査忌避時、領海侵犯時にとり得る実力行使の限界について議論を行った。

The relevant foreign precedents of the Law of the Sea Treaty have been noted, the relevant provisions of the present Law of the Sea Treaty, the Agreement on the Implementation of High Seas Fisheries, the 2005 Protocol to the SUA Treaty, the judicial judgment after the Law of the Sea Treaty has been established, the illegal operation of foreign ships, the investigation and avoidance time, the limit of the exercise of force when the rain dragon encroaches, etc.
