项目摘要

2022年度に於いては、COVID-19に対する警戒体制の緩和を踏まえ、2020年度または2021年度に実施予定であったが見送った在外研究を、英国・ケンブリッジ大学法学部(Faculty of Law, University of Cambridge, England, United Kingdom)の客員研究員として行った。但し、本プロジェクト最終年度であること、また、依然として存するCOVID-19ほか国際情勢上の混乱により、期間を半年に短縮、うち1ヶ月を日英間での出入国にかかる諸手続き(主に入国にかかるCOVID-19の検査等。但し、出国後に日本側で同手続きは不要となった)に充てるものとした。森は、主としてケンブリッジ大学法学部スクワイア法学図書館(主にMaitland Legal History Roomにて)と、University Library(所謂、中央図書館)を拠点とする文献研究を行った(これらの図書館は、英国法定納本図書館に指定されている)。そのほか、現地研究者(受入教員であるStelios Tofarisケンブリッジ大学准教授、Girton College, Cambridgeフェロー含む)や同様に他国からの客員研究員との交流を通じて、多国間比較法の実践とした。また、8月にはJesus College, Oxford及びUniversity of Edinburghに滞在しての、同様の資料収集及び研究交流を行った。具体的成果は、後述の現地研究会報告(King’s College, Cambridge及びUniversity of Edinburghでの二回)、と同報告へのフィードバックを踏まえて日本語化の上、森勇斗「記号論と数理議論学の法的性質の検討への適用 ;「錯誤」の法的構造を題材に」国際商事法務50巻11号1497-1503頁として発表した。
