项目摘要

22年度は前年度に引き続き、武装集団を含む、武力紛争当事者の国際人道法の違反に関連して生じる武力紛争との外にある国（第三国）の義務の分析の枠組みとして、ジュネーヴ諸条約共通第1条の解釈に関する検討を進めた。同条文の解釈から、第三国であっても武力紛争当事者による国際人道法の尊重を確保する義務を負う一方で、その内容についてはあらゆる違反を防止するというものではなく、違反に貢献しないという消極的性質のものに留まることを明らかにした。第三国の確保義務とともに、他主体の違法行為への援助に対する国家責任（いわゆる「国家の共犯」）（以下、援助責任）の実定法性および要件について検討した。援助責任は条約規則でなく、慣習法または法の一般原則にその形式的法源を求めることができるため、国際的な実行だけでなく各国の国内刑法等も参照して実定法性を検討した。要件についても、刑法上の共犯と同様、違法行為と援助との関連と、違法行為を援助することに対する主観が必要とされる点、刑法上の共犯に関する議論から借りることができる一方で、国家責任であるという点でいかなる違いが生まれるかを検討した。これに加えて、違法行為への援助が問題となる状況に適用される他の国際法規則と援助責任の適用をそれぞれ検討し、援助責任の有用性を明らかにした。この研究から得られた結果を博士論文としてまとめ、次年度以降に公表する予定である。
