前年度に続きコロナ禍のため、令和４年度においても本研究の助成金による研究成果は公表するに至らなかった。しかしながら、私（本研究代表者）の研究としては、研究成果公表に向けてさらに一定の進展があった。特に、研究の柱のひとつ、すなわち、保守派裁判官の示す法理、法解釈手法ないし司法哲学に関しては、政治的・社会的に衝撃をもって受け止められた連邦最高裁2021年開廷期末の諸判決の分析に傾注したところである。まず、New York State Rifle & Pistol Association v. Bruen判決は、州法の銃規制規定を合衆国憲法修正第２条（武器保有携帯権）に違反すると判断したが、トーマス裁判官の法廷意見（他の保守派の裁判官５人が同調する）は、徹底した原意主義の立場を採り、一般に権利制約の合憲性を判断する際に用いられる目的・手段審査を峻拒したところに顕著な特徴がある。また、Dobbs v. Jackson Women's Health Organization判決では、保守派の裁判官５人の形成する法廷意見が、５０年近く続いた判例法理を覆し、人工妊娠中絶選択の自由に対する憲法上の保護を否定したが、ここでも歴史・伝統に全面的に依拠する解釈方法が採られた。そして、West Virginia v. EPA判決では、連邦行政機関制定の規則が連邦議会制定法によって授権されていないと判断されたが、やはり保守派６裁判官による法廷意見は、委任立法禁止の原則を厳しく適用する際に憲法上の権力分立原則に関する一定の理解を示している。私としては、これら諸判決から、憲法条項の原意の理解、先例拘束性との関係、比較衡量的手法の回避といった、アメリカにおける保守的法理論の特徴を抽出する作業を行ってきたところであり、近いうちにその成果を論文として公表できる見込みである。
