本研究課題においては、社会縮小時代における地方公共団体の企業的活動の方向性として、その持続性の維持についての法制度・法政策のあり方とともに、当該活動に対する公法的規制に係る理論の研究も進めることになっている。本年度は、日本におけるその公法的規制理論の課題に比重を置いてその研究を進めた。そこで、東アジア諸国における公企業に対する行政法的規制に係る理論研究の動向・方向性を調査することにした。このことにより、これまでとりわけヨーロッパ（特にドイツ）の関係の法制度・法理論に着目してきた本調査研究に別の視角から光を当てて考察することが可能となり、本研究をより広い視野から位置づけ、検討することができることになった。例えば、令和4(2022)年12月3日・4日に開催された東アジア行政法学会学術大会における「公企業に対する行政法的規制」をテーマとする台湾及び韓国の各研究者の報告が当該国の公企業の状況及び行政法的規制の理論の動向・方向性を明確にした。すなわち、台湾では、公営事業の増加の傾向が見られるなかで企業経営方式が望まれるとされるものの、法治国家の公益原則や人権保障の観点からの人事・財務・業務に関する行政的規制・監督法制のあり方に係る検討がさらに求められていた。また、韓国では、地方公企業法に基づく公企業が411団体存在するほか、地方自治団体出資・出捐機関の運営に関する法律の適用機関が845機関にも上る状況において、民主化や法治主義の強化の観点から公企業法原則の再検討が迫られていることが明らかとなった。近隣資本主義国においても、地方公共団体の企業的活動の公共性・公益性を保持するための公法的規制及びその理論の必要性が強く要請されているといえよう。このような観点を意識した本研究課題の研究遂行の重要性がより明瞭となった。
