项目摘要

本研究は、平成28年刑訴法等改正により導入された新制度の下での今後の弁護人の活動の在り方を理論的観点から検討することを主目的とするが、平成16年改正以降の刑事手続とりわけ裁判員制度の下での弁護人の活動やその体制の現状を分析した上で上記新制度の下での課題を検討する必要もあるため、その作業を昨年度に引き続き行った。さらに、平成28年改正以降の法改正の動き（性犯罪関連の手続法改正、刑事手続のＩＴ化等）をも見据えた弁護活動の在り方を探るべく、これらの動きを追跡・分析する研究を進めた。また、捜査構造論との関連では、日本刑法学会において証拠法分野の議論状況を総括する報告を行う中で、公判・証拠法と捜査・公訴との関係について考察し、その際、公判改革と捜査構造の改革を一体的に論じる言説の当否を検討した。その結果、我が国における公訴権運用の現状とそれに対する評価を踏まえると、捜査の問題と公判の問題とを一体的に論じるのではなく、むしろ捜査と公判の分離を徹底することこそが重要であり、他方で捜査手続改革はそれ自体として検討すべきであるとの結論に至った。
