本研究は、EUにおいて多数の消費者に共通した財産的被害を生じさせる消費者の利益を侵害する行為に関し、被害者たる消費者個人からの提訴方法には多くの限界があるため導入されている民事法及び行政法上の集団的消費者被害回復制度を研究し、その制度における私法と公法の役割を明らかにし、それに基づいて我が国の同様の問題を検討する。このため、本年度においては、第一に、本研究は、行政処分による集団的消費者被害回復について、競争法（日本の場合には独禁法）上の場合と、消費者法上の場合を検討する。EU、ドイツにおける制度を検討し、我が国の独禁法及び消費者法分野の行政処分による集団的消費者被害回復手法について、私的自治の原則との関係を押さえつつ、研究を行った。第二に、本研究は、デジタルプラットフォーマーによる独禁法・消費者諸法違反事例におけるこれらの集団的消費者被害回復方法の役割を明らかにすることを目的とする。多数消費者被害の事例にも応用可能な独禁法上の確約手続について、2022年度に東京経済法研究会にて報告を行った。2023年度に、その成果を獨協法学120号（2023年）に公表する。第三に、第一及び第二の研究を踏まえ、2022年度には、行政処分による消費者被害回復手法について、獨協大学の研究図書出版助成金を得て約400頁の単著『行政処分による消費者被害回復の理論―EUデジタルプラットフォーム規制の考察と我が国の課題』法律文化社（2023年）を出版した。第四に、第二の研究を踏まえ、景品表示法への確約手続の導入について考察した論文「景品表示法上の行政措置の変遷と課題：課徴金制度の改善・確約手続の導入」現代消費者法58号（2023年）63－72頁を公表した。
