项目摘要

本年度は、次の通り、昨年度までに得られた分析結果をまとめた論文の改訂を主に行った。(1)　特許技術のライセンス料である（一括払い料金と従量料金を併用した）2部料金が交渉によって決まる状況を分析した研究について、分析結果をまとめた論文を査読付き国際学術誌に投稿し、レフェリーからコメントを得た。そのコメントに対応するために、交渉プロセスの中で特許技術の所有者や潜在的なライセンシーが提案できる2部料金の範囲を（本研究で当初想定していたものよりも）広げることよって、交渉の結果にどのような影響が出るのかを追加的に分析した。2部料金の範囲を広げた場合、交渉の結果としては不自然なものであったり、交渉の結果が存在しなくなったりすることが明らかになり、本研究で当初想定していたモデル（交渉の中で提案できる2部料金の範囲の設定）の妥当性が増す分析結果を得ることができた。また、より精緻に分析することによって、特許技術の所有者が一人の潜在的ライセンシーにのみ特許技術をライセンスする状況も特定することができ、ライセンス料をオークションで決定する先行研究とは異なる分析結果が得られることも分かった。本研究に関しては、現在も、論文を改訂中であり、次年度に査読付き国際学術誌に再投稿する予定である。(2) また、特許技術の先行保護の範囲が累積的な技術革新に与える影響を分析した研究についても、特許技術のライセンス料交渉を協力ゲームとしてモデル化した部分について既存の理論と整合的になるようにモデルの修正を行った。その修正したものを論文にまとめ、ワーキングペーパーとして公開した。(3) さらに、今後の研究に活用するため、相互依存する複数の二者間交渉に関する先行研究のサーベイを行い、分析方法やその結果などを調査した。
