今年度は最終年度であるが、出産により、研究を一時中断した。予定より遅れているものの、研究計画における【C.】を中心に研究を行った。まず、国内人権機関と人権条約の一般実施条項の関係で、後者の発展的解釈を検討する際に、新たな視点を見つけた。これまで、総括所見で示された条項は、条約機関の同条に基づく義務の表明だと考えてきた。考察を進めると、この理解が軽率であるように見えた。総括所見は厳格の違法性の判断手続ではないため、条約の完全な実現に資する政策の勧告も含まれうる。条項の明示はあくまでも条約との関連性の提示という可能性もある。この種の総括所見の不遵守は条約違反にならない。ただしそうすると、総括所見の類型化の問題が生じる。他方、子供の権利条約委員会の一般的意見2で示された「国内人権機関の設置は4条のコミットメントに含まれている」という文言は、依然として4条の義務の表明と理解したほうが自然で、一般実施条項の人権条約機関による発展的解釈としか考えられない。国内人権機関の設置は政策的勧告にとどまるか、人権条約の一般的実施条項の発展的解釈により導出されるのか。また条約により結論が異なるのか。これらの問題に留意し研究を進める。次に、普遍的定期的人権審査（UPR）における国内人権機関に関する勧告および被審査国の回答の法的意味の研究を行った。UPRの勧告は、被審査国が受け入れるかどか示す必要がある。本研究は、受け入れる場合、国際法上の一方的行為と類似し、遵守する義務を負うと主張する。そのため、UPRと一方的行為について調べた。他方、考察する中、UPRはあくまでも国連の政治機関による政治的な手続であるため法的意味を生じないであろうという主張も見られた。本研究は、両方の根拠をも論じ、私見を示す。今後、残った部分の研究を進み、これまで着手した部分も見直し、論文として仕上げ、本研究を終了する。
