项目摘要

令和3年度において、当初計画していた研究内容についてはおおむね完了していた。本研究は、新型コロナウイルス感染症が流行する以前に採択されたものであり、とくにドイツの学術交流にも重きを置いているものである。令和4年度も新型コロナウイルス感染症が継続していた上に、ロシアによるウクライナ侵略が生じたことから、学術交流が非常に厳しい状況にあったため、当初の計画より期間を延長した。そこで、2022年度は、篠原永明准教授を中心に、基本権がどのような構造を持ち、それをどのように理解すべきか、について追加で検討した。基本権には、国家が自由に介入しない不作為を求める防御権が、第一次的に認められる。防御権の他にも、客観法的な要請として、本研究のテーマとの関連においては、とくに内容形成が問題となる。これらの基本権の機能については、形式的には二つの問いが立てられうる。まず、個別の基本権の保障領域とその制限がどのような関係にあるのか、という問いである。次に、基本権の各機能が個別の基本権の規定の仕方とどのような関係にあるのか、という問いである。しかし、実際は、第一の問いと第二の問いは相互に関係があることが明らかになる。つまり、個別の基本権が、どのように規定されているのか、とくに制限を予定する表現か、内容形成を予定する表現かによって、個別の基本権規定における基本権の各機能がどのように現れ、また個別の基本権規定がどの国家機関を名宛人したものか、を詳細に検討することができる。このテーマをドイツ国法学との比較において行った。また、本研究の代表者と分担者が2019年から2022年までに行ってきた研究について、ドイツ側の研究協力者に質問する機会を設け、内容面での精度を高めた。
