今年度は、研究成果としては宗教憲法と国家憲法の衝突に関する直接的な検討を行うことが必ずしもできなかったが、同様の構造をもつ部分憲法や、さらには全体憲法と部分憲法に関わる方法論に関する検討については、論考を公表することができた（「憲法学の方法：憲法理論・憲法史・比較憲法」論及ジュリスト３８号）。具体的には、宗教憲法と同様の構造を持つと思われる防衛憲法について、最近のドイツの判例法理の展開や基本法改正の動向などを踏まえ、民主政や法治国という構造原理を持つ全体憲法としての政治憲法が、そのような構造原理を持たない部分憲法において浸食される状況について、明らかにすることができた（「憲法判例の文脈化と機能化：レプシウスの連邦憲法裁判所批判」。さらに、水島朝穂教授古稀記念『自由と平和の構想力：憲法学からの直言』、及び小山剛・工藤達朗編『憲法裁判の制度と実践』にて、来年度中に公表の予定である）。加えて、宗教憲法および国家憲法の衝突に関わる、個別的な事案の検討（ドイツにおける教会法による規律と憲法上の諸原則との衝突、いわゆるカルト規制による民主政原理や法治国原理の遵守、など）も進めることができたが、これに加えて、ドイツ基本法における宗教に関する現在の各種状況を、日本国憲法における同様の現象と比較する作業にもすでに着手しており、順次、紀要や日本の研究者と計画している共著などにおいて公表する予定である。

This year's research results include a direct discussion on conflicts between religious constitutions and national constitutions, a methodological discussion on the relationship between the whole constitution and some constitutions, and a discussion on public statements ("Methods of constitutional law: constitutional theory, constitutional history, comparative constitution"). Specific, religious, constitutional, and constitutional issues are discussed in detail in the Defense Constitution, recent case law developments, and trends in the revision of the Basic Law. Democratic governance and rule of law are discussed in detail in the Constitution as a whole. Political constitutions are discussed in detail in detail in the Constitution as a whole."The Constitution of the United States: A Review of the Constitution of the United States." Professor Asahiro Mizushima commemorates "Freedom and Peace of Thought: Constitutional Law" and "Constitutional Justice System and Practice" edited by Takashi Koyama and published in the coming year.
