项目摘要

2022年度には、前年度から引き続き、本研究課題の当初の問題意識を一般化した公益の実現に携わる私人の役割に関する論文を執筆し、これに関する研究発表をも行った。すなわち、法律時報2022年5月号から8月号にかけて4回連載の「プラットフォームとインフラストラクチャーをめぐる法の一般原則：「法の下の平等」の私法的基礎づけを含めて」という論文を公表した。関連して、7月28日に立命館大学・京都大学共催の租税論研究会において「終局的な義務者でない者による義務履行」、9月10日及び11月26日に「プラットフォームとインフラストラクチャーをめぐる法の一般原則：「法の下の平等」の私法的基礎づけを含めて」（それぞれ、GDPG科研・千葉科研）と題する研究報告を行った。さらに、公益の実現と法に関する神奈川大学法学研究所の研究会において「一見したところ憲法上の権利として列挙されていない利益を損なう一般的な規律に対する裁判所による合憲性審査の可否及びその判断基準について」と題する報告を行った（2023年2月23日）。この他、「所有者不明土地・手続保障・固定資産税」秋山靖浩編『新しい土地法』33-59頁（2022年4月）（本科研2020年度の研究成果の書籍化）がある。さらに、「国際課税の地殻変動」租税法研究50号17-33頁（2022年6月）、「公益の実現における私人の役割：実体法と手続法」法律時報94巻10号108-111頁（2022年9月）、「Will Bateman, Public Finance and Parliamentary Constitutionalism」（書評）国家学会雑誌135巻9=10号809-811頁（2022年10月）、「金子宏先生を偲んで－『所得課税の基礎理論』を読む」税務弘報71巻1号91-94頁（2023年1月）を公表した。
