项目摘要

研究4年度目である2022年度は、研究計画に従い、サイバーリスクと新型コロナウイルスの研究を継続するとともに、これまで継続してきた企業保険研究をさらに進めた。具体的には、以下の通りである。第一に、生命保険会社の新型コロナウイルスへの対応の検証を行った。生命保険会社の対応（保険料払込猶予期間の設定、入院給付金の給付対象、通院、災害割増特約の支払対象、通院）の調査を行い、それぞれの対応の理由と約款上の正当性の検討を行った。検討対象は多岐にわたるが、とりわけ約款上の給付事由である「入院」概念における問題点が中心となった。給付事由を定義する約款規定に照らすと、生命保険会社による新型コロナウイルスへの対応（特に、宿泊療養・自宅療養に対する給付）は給付事由に該当するか疑わしい、または明示的に該当しないにもかかわらず、入院給付金が支払われた事例が多いものと結論づけられた。第二に、サイバーリスクに関する研究を続け、異なる法分野の研究者・実務家及びセキュリティの専門家との座談会の形で業績を公表した。第三に、責任保険と再保険を中心に企業保険分野の実態・約款・裁判例等の研究を継続して進めた。とりわけ中心となる責任保険については、米国の責任保険法リステイトメント(Restatement of the Law, Liability Insurance)の研究を進めるとともに、責任保険のうちD&O保険の研究を優先的に進めており、商品構造・商品設計、免責事由の約款構造、構造的な利益相反の研究を進めている。
