こんにち市民の環境意識の高まりを受けて、消費における環境配慮や、土地上での自発的な環境保全など、私人のイニシアティブによる環境保全を契約を通じて実現する、環境の法的保護の契約化というべき現象がみられる。本研究は、この分野において近年議論が進展しつつあるフランス法を参照して、わが国への示唆の可能性を探求するものである。2022年度前半においては、2021年度後半に執筆した不動産上での環境保全実施に関する契約および消費契約における環境配慮に関する２論文の刊行に向けた作業をすすめ、また並行して、フランスにおける環境法の契約化に関する新たな研究情報の収集作業を行った。2022年度の年度当初においては、フランスの研究の進展状況に鑑みて昨年度に引き続き、2021年に立法された消費者契約における環境配慮等、フランスにおける個別立法の分析を中心に研究を進める予定であった。しかし、個別立法に関して新たな研究情報が当初の想定に反して収集できなかった半面、2022年度の中盤には、環境法の契約化に関連する内容を含む本格的な博士論文が複数刊行されるなど、このテーマについて基礎理論的な議論に深まりがみられたことから、2022年度後半においては、それら論文の分析を中心に研究を進めた。これまでの研究によって、環境の法的保護の契約化においては、環境保全の見地からの契約のコントロールの根拠としての公序（環境公序ないしエコロジー公序）と、当事者が契約において環境配慮を行う前提としての環境情報コミュニケーション（環境に関する情報提供義務）の2点が柱となると考えられるところ、2022年度においては、後者の視点（環境情報コミュニケーション）に関連するものとして、デジタルプラットフォームが環境の法的保護に与えうる影響に関して、フランスの研究者の論稿の翻訳を行った（公表は２０２３年度中を予定）。

The high level of public environmental awareness, consumption, environmental allocation, self-development on land, private environmental protection, environmental protection contract, environmental law protection and contracting phenomenon are all under discussion. This study is aimed at exploring the possibility of the development of the research methods in recent years. In the first half of fiscal 2022 and the second half of fiscal 2021, we will write contracts related to environmental protection implementation on real estate and environmental protection related to consumption contracts, and collect new research information related to environmental law contracting in parallel. In 2022, the progress of research on environmental protection was reviewed. In 2021, the legislation of consumer contracts was reviewed. Environmental protection was reviewed. In 2022, the analysis of individual legislation was reviewed. In 2022, the central research paper was published in the second half of 2022, and the contents of the doctoral thesis related to the contracting of environmental law were published in multiple times.
