项目摘要

米国やEUにおいて、子どもの個人情報・プライバシーに関わる法や規則が新規に複数成立したため、改めて日米欧の法制度の全体像、その運用と執行について検討を行った。子どもの個人に関する情報がEdTechを介して扱われる場面を(1)学校教育（学校教育法上の学校における教育、宿題などの家庭学習を含む）と(2)学校外での学習活動（子どもが個人的に利用するオンライン教育教材、SNSなど）の２つに分け、それぞれの法規制とその運用、執行状況を日米欧で整理し検討した。(1)に関しEUには、EU一般データ保護規則（GDPR）とは別に、教育記録（個人情報として扱われないものも含む）の取得・保有や保護者の閲覧・修正等に関する法規定を置く国がある。米国は、包括的な個人情報保護法は存在しないが、教育記録（EUと同様にいわゆる個人情報よりも広い範囲の教育データ）に関する取得、利用等の連邦法がある。保護者及び本人の教育記録の閲覧・修正等が認められ、また州法ではさらにそれらが細かく規定されている。日本は、個人情報に該当する教育記録に関して個人情報保護法上の保護がされているが、それ以外の教育記録に関して明確に規定がない。ただ、米欧においても教育記録に関する法の運用や執行に関しては課題も多いことが明らかとなった。(2)に関して欧米では、子どもに対するサービスの提供者は、プライバシー設定をデフォルト状態で高度なレベルにしておくこと、子どもを対象としたターゲット広告の配信は許されず、位置情報の収集もオフとすることが必須など、かなり厳しい細かな法や実施規則を採用する国や地域が増えてきている。日本は個人情報保護法の保護範囲に現在はとどまっている。2022年度は、(1)について日本における教育記録に関する法制度の検討、(2)は日本におけるサービス提供者に対するより厳しい細かな法または実施規則策定の検討を行った。
