项目摘要

本研究は、環境問題のなかでも、不動産をめぐる環境問題について、土地所有者が負うべき責任や地方自治体の土地利用規制権限のあり方、そして地方自治体と国との役割分担などを中心に検討するものである。本年度の大きな研究成果としては、アメリカについては、一昨年と昨年に収集した文献を用いつつ、2020年4月20日の土壌汚染に関するアメリカの連邦最高裁判決(Atlantic Richfield Co.v. Christian)を題材に、同判決における土地所有者責任、具体的にはスーパーファンド法上の潜在的責任当事者該当性を検討し、同判決がアメリカの土壌汚染浄化政策に与える影響について考察し、これを公表した。なお、正木宏長ほか編の翻訳本『現代アメリカ環境法』(尚学社、2022年)が出版され、私はアメリカの土壌汚染に関する法律(スーパーファンド法）の翻訳を担当した。わが国の研究成果としては、判例研究をすすめた。具体的には、太陽光発電設備の設置問題に関し、伊東市の河川占用不許可処分に対し、太陽光発電エネルギーによる発電事業等を目的とする合同会社が提起した河川占用不許可処分の取消訴訟につき、検討を加え、これを環境法研究にて公表した。。同判決は、第１審判決が河川占用不許可処分における伊東市長の裁量権の逸脱又は濫用を認め、河川占用不許可処分を取り消したのに対し、同処分における市長の裁量権を広く認め、逸脱又は濫用を認めなかったものであり、興味深いものである。
