项目摘要

2022年度日本スポーツ仲裁機構で仲裁判断がなされた事例は、10件が報告されている。本課題とかかわり、直接的な選手選考結果の取り消しを争った事例としてフェンシング女子のアジア大会派遣選考者の取り消しと申立人を選考することを求めたものがある。この事例では、コロナ渦の影響で海外大会が順調に開催されない中、ランキングのみでの選考決定に疑義があり、取り消し変更の申し立てがなされたが、仲裁パネルは定着してきた4要件をもとに、訴えを棄却している。また、自転車競技の大会開催見送りで、競技会に参加できなくなることで不利益を被る可能性（男女の平等の争点も含む）があり、その大会開催を求めた事例がある。しかし統括する国内スポーツ連盟の運営について一定の自律性を認め、同様に４要件を引きながら棄却している。これらはコロナ渦での特別なケースでもあった。そのほか、パラ・バドミントン2022 年度強化指定内定選手・次世代アスリート育成強化内定選手の決定において申立人を除外したことを争った事例においても、申立人の請求を棄却している。その一方で、パワハラによる競技者の活動停止処分の取り消しを認めた事例では、最低限の手続保障を欠いていたことを理由として、その取消しを命じた。また、テニス日本リーグの選手登録をめぐる事例では、選手の登録を認め参加する権利が保障されている。これら以外にコロナ感染とかかわりゴルフ国体選手の県代表の選出基準を明確にすることを示した例、ローラースケートの国際大会への日本代表選考会とする決定を取り消した事例など、いずれも広く競技者の参加する権利とかかわる裁定がなされた。一方、アメリカでは、競技者の包括的メディカルケアとともにメンタルヘルスへの対応が取り上げられていること、トランスジェンダー競技者の参加資格問題や男女同一の賞金等の課題が競技者の権利や競技団体のガバナンスの点でも注目されている。
