项目摘要

本年度は、①2021年度に親密圏の構成員のヴァルネラビリティ（脆弱性）と関連する具体的問題として取り上げた「離婚後の非監護親の面会交流の実施にかんする問題」について、近年導入が検討されている「共同親権」をめぐる議論との関連性も含めて引き続き検討を進めた。さらに、本年度は②フェミニズムの身体論を手がかりに、セクシュアリティと身体をめぐる問題について検討し、セクシュアリティおよび身体と法制度の関係ついて考察を進めた。②の研究は、2020年度の「人工妊娠中絶の権利をめぐる議論」を具体的問題として取り上げ、「身体的統合性（bodily integrity）」概念をヴァルネラビリティ論の観点から検討した研究と関連している。2020年度の研究を通して、フェミニズムで論じられてきた「身体性」をめぐる議論を踏まえて「身体的統合性」の概念の考察を深める必要があると考えるに至った。そのような中で、2023年度の日本法哲学会学術大会において「セクシュアリティ」をテーマとして扱うグループでの報告の機会を得たため、身体と密接に関連する「セクシュアリティ」について、フェミニズムによる「身体性」をめぐる議論および「身体的統合性」概念を手がかりに、セクシュアリティおよび身体と法制度の関係ついての研究に取り組み始めた。②について、2022年度内では、これまでのフェミニズムの「身体性」に関する議論の理解を深めると同時に、近年ではフェミニズムの身体論が注目されているHealth Lawの領域におけるフェミニズムの身体論の影響について確認した。①については、2022年度内に成果を発表する予定であったが、共同親権導入をめぐる議論がまだ活発に行われているため、成果をまとめるには至っていない。これらの議論を踏まえて成果を発表する予定である。
