项目摘要

本研究は、連合王国を対象として、個人と国家の関係性を明白に示すものとされている国籍概念を再検討し、国家における法的構成員とは誰かを明らかにしようとするものである。2022年度は2021年度より継続して、連合王国の国民概念へのBrexitによる影響を検討し、分析結果を研究論文として公表した。EU構成国市民は連合王国の国籍法上は外国人とされていたものの、関連法規により連合王国への入国や在留は自由とされていた。入国規制は大きく、EU構成国市民に対するものとそれ以外の外国人に対するものに分けられ、後者には特に厳格な政策が採用されてきた。そしてEU構成国市民はイギリス国内ではイギリス市民同様に様々な権利を享受していた。つまりEU構成国市民は外国人でありながらイギリス市民に非常に近い取扱いを受けていた。連合王国では国籍法で自国市民が定義されておらず、さらに連合王国本国から旧植民地の市民にも法的地位を認めており、国籍概念・国民概念は非常にあいまいで、国家と個人の関係は多様であった。このような状況においてEU構成国市民は国民概念の周縁に位置づけられていたと考えられる。Brexit後、EU構成国市民は外国人として厳格な入国規制の下に管理されることになった。その位置づけは後退し、外国人として明確に扱われることになった。これにより、イギリスの国民概念は、イギリスの国籍法で法的地位を認められている者については曖昧で多様であるが、EU市民も含め外国人については、境界線は明確化したといえる。
