令和４年度においては、新型コロナウイルス感染症にかかる社会状況のもとで続いていた研究資源上・研究環境上の制約が徐々に緩和されて、研究会・学会の実施・参加の状況がおおむね以前と同じようなものに戻ったのとともに、前年度までに出版・公表が滞って遅れていた文献・資料の多くに接することもできるようになった。これらの調査・分析の過程で、日本の内外で、この数年来の社会状況の変化に応じて、刑事手続法の改正をめぐる議論や新たな社会問題にともなう刑事手続法上の課題が提起・指摘されて、これにも着目して検討を加えるのが必要なものと認識したため、前年度までの研究の整理とともに取り組んだ。とくに、この２年ほどの間にヨーロッパ各国において進展した制度の内容・状況（ＥＵによる規制と各国の刑事手続法との関係なども含むもの）に対して所定の調査にあたったのとともに、この３月に閣議決定された「刑法及び刑事訴訟法の一部を改正する法律案」において「被害者等の聴取結果を記録した録音・録画記録媒体に係る証拠能力の特則の新設」が盛り込まれたのにともなって、これについての研究を進めた。後者に関しては、法律案において新設されるものが証拠法にかかる制度の拡張に尽きているところ、証拠法の問題にとどまらない制度のあり方を構想するという本研究の観点から、令和４年度においては、法律案に至るまでの近時の議論を整理して分析を加えることと、法律案に対するさらなる検討の余地と今後の課題について明らかにすることに取り組んだ。
