项目摘要

「他人になりすまして電子記録の請求における意思表示をした者の責任」に関して、研究会報告と論文を執筆した。他人によって電子記録の請求の意思表示がなされる場合に、その他人が権限を有していなかったときには、その他人の法的責任および名義人本人の法的責任はいかに考えるべきであろうか。権限のない他人によって電子記録の請求の意思表示がなされる場合、代理方式が採られていれば「無権代理」、代行方式が採られていれば「なりすまし」として取り扱われるが、立案担当者は、両者を区別することなく、次のように解している。すなわち、無権代理人やなりすましの責任については、電子記録債権法13条によって「過失」を「重大な過失」と読み替えられたうえで、民法117条が適用ないし類推適用され、本人の責任については、民法の表見代理の規定が適用ないし類推適用されると解している。要するに、無権代理の場合もなりすましの場合も、民法の代理に関する諸規定が適用または類推適用されると考えている。しかし、実務において、電子記録の請求は原則として債務者請求方式がとられており、また、基本的にインターネットを通じてなされる。このような現状においては、債務者の電子記録の請求が他人によってなされたか否かについて、相手方は関知しようがないのではなかろうか。それにもかかわらず、権限のない他人によって電子記録の請求の意思表示がなされる場合に、果たして民法の代理に関する諸規定を適用または類推適用することは妥当であろうか。この点に関して、手形の偽造における議論を参考にし、かつ、手形法と電子記録債権法との差異に留意して、検討を加えた。今後、電子取引が増加していくであろう社会において、電子記録債権法にかかわらず、なりすましをした者に対して現行法において如何に対応するかの検討は必須であり、本研究はその検討の一つとして意義を有する。

"The responsibility of the person who requests electronic records" is related to the writing of the paper of the seminar. The provisions of the Civil Code relating to the representation of the intent of the request for electronic records shall apply analogously to the application of the request for electronic records. This point is related to the hand shape and falsification of the discussion, the hand shape method and the electronic recording debt method of the difference, the discussion is added. In the future, electronic acquisition will increase in the society, electronic recording debt method, how to deal with the problem, this study will have a significance.
