项目摘要

第一に、「何が差別を不正にするのか」について、危害説にとって残された二つの課題を検討した。（1）どのような「危害」でも算入するべきか。たとえば、差別的行為の直接の対象ではないが差別に用いられた性質を共有する人々が被る危害（スティグマ危害）を算入すると、差別の不正性が被差別集団のサイズに依存してしまう。ただし、これは危害説（福利主義）自体の問題ではなく危害の大きさだけが重要だとすることの問題である。ひとつの解決策は、福利主義を維持しながら帰結主義や総和主義を放棄することだ。第二の解決策は、上の反直観的含意は「福利とは何か」への解の誤りに起因すると考えることだ。（2）現在の行為の規範的評価において過去の差別の有無を引き合いに出すことは、危害の多重算入ではないか。ひとつの応答は、過去の差別がそれ自体で重要だという直観を退け、現在において道徳的影響をもつ場合に限って過去の差別を参照するというものである。第二の応答は、やはり「福利とは何か」の解の再検討だ。仮に福利／危害が特定の時点に紐付けられない価値であれば、「現在の／過去の」危害は有意味な区別でない。第二に「福利とは何か」を検討した。すべての福利主体に適用可能な「福利とは何か」への解はあるか。たとえば、感覚的快楽説は大人の人間の福利を理解できず、他方で、人生満足説は乳児・重度障害者・動物の福利を考える上で要求過多だ。ひとつの解決策は福利可変主義（福利主体ごとに「福利とは何か」の解自体が変わるという立場）だ。私は別の解決策を探求し、欲求充足説や人生満足説の一般形として手続主義的卓越主義を提案した。この立場は、近年あまり支持されない福利主観主義のひとつだ。もし福利主観主義が擁護可能ならば、これを福利主義と組み合わせて、障害にかかわる規範的議論が「一般に重要だと思われている身体的・精神的特徴」を特別視するべきでないことの根拠になる。
