本研究の目的は、欧州人権条約５条４項の解釈に関する議論を参照することで、対審手続を受ける権利（市民的及び政治的権利に関する国際規約（B規約）９条４項）に基づき、被疑者及び弁護人が、捜査機関側の有する身体拘束の根拠となった資料の内容を知る権利（資料開示請求権）を有すること、また、当該権利の法的性質・内容・限界を明らかにすることにある。研究初年度である令和４年度は、対審手続を受ける権利自体の沿革・趣旨の解明に取り組んだ。具体的には、以下の２点を重点的に行った。第１に、対審手続を受ける権利が導かれた理由及び経緯の解明である。対審手続を受ける権利は、B規約９条４項や欧州人権条約５条４項において条文の文言上明示されていないが、解釈上、認められている。対審手続を受ける権利が解釈上認められるようになったということは、条約制定後に、対審手続を受ける権利を保障する必要が生じたということである。そこで、欧州人権条約を中心としつつB規約についても、条約制定時に遡って出来るだけ幅広く体系書、研究書、立法資料等の文献を収集し、分析した。第２に、B規約９条４項、欧州人権条約５条４項と他の規定との関係の解明である。本研究の目的をふまえると、対審手続を受ける権利についての文献のみを収集し、分析すれば足りるとも思える。しかし、同権利が導かれるまでには沿革があり、その沿革の中で同権利がどのように位置付けられてきたのかを分析することで、同権利の特徴が明らかになる。そこで、同権利以外の関連する権利についての文献も収集し、分析した。
