令和４年度は、米国のADRの制度全般及び調停プロパーに関する事柄について、概説書を購読し、一般的に論じられることについての把握に努めた。また、わが国の司法型調停及び民間型調停に関する文献が近時複数発刊されていることから、それらの購読を通じて近時のADRに関する議論のキャッチアップに努めた。司法型調停に関しては、近時の法的観点を踏まえた調停の源流となっているとも考えられる調停裁判説を再考するとともに、法史学の観点から調停において法的評価を行うことについての端緒や経緯を検討した。また、民間型調停に関しては、法社会学的な観点からその役割や位置づけについて検討を進めた。以上のような文献調査に加え、仙台弁護士会において開催されているADR事例研究会に参加する機会を得、実際のADR事例について、手続実施者及び当事者からの報告を聞くとともにディスカッションに参加した。また、一般財団法人日本ＡＤＲ協会調査企画委員会委員の立場で企画・立案・コーディネーターとして携わった同協会主催のシンポジウム（ADRの国民への浸透と利用拡大）において、弁護士会や民間事業者によるADRの取り組み等についても触れることができた。この際の議論を通じて、民間型調停にあっても評価型調停が否定されるものではないこと議論にも触れ、これらのわが国の実務の取り組みの中で、法的評価を行うことの位置づけ及び意義について、今後研究を深めていきたいと考えている。
