项目摘要

本研究は、相続財産をどのように承継するかについての決定の自由がいかに保障されるべきか、検討するものである。家族関係や私的自治にいかに配慮し、これを保護すべきか、検討する必要がある。本研究では、ドイツにおいて蓄積された議論を分析し、これとの比較を通じて、わが国においてはどのような制度設計や運用のあり方が適切であるかを明らかにする。この研究を遂行するために、必要な雑誌および書籍、さらには周辺領域に関する最新の議論の動向を知るためにドイツの最新の文献や判例について、調査を行った。ドイツにおける遺留分を事前に放棄する契約の内容規制に関する議論を見てみると、ドイツにおいては、わが国と異なり、放棄契約にあたり家庭裁判所の許可は必要なく、公証人による公証がなされるのみであり、公証手続においては丁寧な配慮が必要であることが指摘されている。そこで、公証人が果たす役割についても着目しながら、研究を進めている。本年度は、遺言の解釈にまつわる最新の裁判例について検討を行う判例評釈として、『家事法の理論・実務・判例』（2023年）に拙稿「判例解説：東京高判令和3・4・13金判1623号22頁――封筒に記載された文言と遺言の解釈」を、法学セミナーへ、婚姻と法に関する特集にあたり拙稿「離婚時に考えたいこと」法セ811号（2022年）31-43頁を、相続にまつわる最新の裁判例の解説として拙稿「民法1050条の特別の寄与および除斥期間経過の有無について判断した事例」法セ813号（2022年）120-121頁を寄稿した。学会および研究会については、家族法についての知見を得るため、日本私法学会（2022年10月、オンライン参加）、日本家族〈社会と法〉学会（2022年11月、於成城大学）、ドイツ家族法研究会例会（オンライン開催）に参加した。
