【目的】知的障害児・者に交付される療育手帳は、身体障害者手帳や精神障害者保健福祉手帳と異なり、法律による裏付けのない、厚生事務次官通知「療育手帳制度について」による制度である。この通知等による概要の規定はあるものの、制度開始から現在に至るまで、各自治体がそれぞれに規定・運用を行っている。地域の特性や事情に合わせた運用という点では妥当性は有しているように思われるが、自治体間の違いが当事者の混乱や不利益につながる可能性は否定できない。従来、その問題点が指摘されてきたが、データを示したものはごく少なく、行政による調査や検討も全国規模のものは見当たらない。障害者認定に関する制度は障害者の法的位置づけ、福祉、就労など、多岐にわたる問題であり、一定程度の統一を図っていくことは必要と考えられる。各自治体の制度の調査を通じて、基礎的な情報を収集することを目的として本研究を行った。【方法】全国69自治体の児童相談所(分室・支所含む)228か所に質問紙を郵送し、郵送にて回収した(調査期間は2015年6～8月)。質問紙の主な内容は、手帳の名称、取得可能な年齢、保護者への結果の報告、更新および再判定、判定に用いられる検査・尺度、等級とその基準、他機関での検査結果の利用、であった。回収後、2015年11～12月に17か所に対して電話による追加調査を行った。【結果と考察】60自治体161か所から回答を得た(回収率70.6%)。手帳の名称や「最重度～中度」の等級の基準以外の部分は自治体間で大きく異なっていた。当事者にとって実質的な影響が大きいと考えられる、判定に用いられる検査・尺度、「軽度」の等級の基準といった点は、自治体間の差異が特に大きかった。これらは不平等につながる可能性を孕んでおり、早急な議論や検討が望まれる。従来指摘されてきた点を実証的に示した意義は大きく、本研究が今後の障害福祉施策の充実や法整備の一助となることを期待したい。
