国立大学法人化後、アカデミアの特許出願件数は増加しているが、特にライフサイエンス分野においては、他分野と比較して実施可能要件の拒絶理由が多く、拒絶理由を解消するために特許請求の範囲を減縮することが多い。医学系アカデミアの特許出願では、実施例に基づき適切な特許請求の範囲を作成することが重要であると考えられ、本研究では既に特許査定となっている事例に基づき、望ましい請求項の立て方について検討することを目的とした。特許電子図書館を用いて、国立大学法人化後の医学系アカデミア特許出願の内、特許査定となった案件を抽出した。特許公報を検索対象として、出願日が2004年4月1日以降、出願人に「大学」を含むが「会社」を含まず、国際特許分類がA61K(医薬用、歯科用又は化粧用製剤)と前方一致する案件を検索した結果、ヒット件数は442件であった(検索実施日 : 2013年7月25日)。ヒットした案件について、特許出願時と特許査定時の請求項数を比較し、両者の請求項数が同じ案件86件(海外の出願は除く。)を抽出して個別検討を行った。抽出案件は、1. 拒絶理由通知が発行されずに特許査定となった事例(30件)と2. 拒絶理由通知が発行された後、意見書等を提出して特許査定となった事例(56件)に分けることができた。前記1は、特許出願時の特許請求の範囲が実施例に裏付けられた範囲と同等のものが多かったが、実施例の記載を充実させることによって、上位概念を含む広い権利範囲が確保できるように工夫している事例があった。前記2は、拒絶理由を解消するため、請求項に記載された選択肢の一部を削除していたものが多かったが、意見書で発明の本質等を明確に述べることによって、最小限の減縮で特許査定となっている事例があった。以上より、医学系アカデミア特許出願において、実施例を充実させて適切な請求項を立てることが、広い権利範囲を有する特許権の取得につながること分かった。
